A BILL

To authorize the Secretary of Defense to enter into a limited number of cost-plus incentive-fee contracts for the Sentinel Intercontinental Ballistic Missile program, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Short title.

This Act may be cited as the “Sentinel Program Construction Risk Mitigation Act of 2023”.

SEC. 2. Form of contracting authorized to mitigate risk to Sentinel program schedule and cost.

Notwithstanding section 3323 of title 10, United States Code, the Secretary of Defense, for a military construction project associated with the Sentinel Intercontinental Ballistic Missile program launch facilities, control centers, and related infrastructure, may use a cost-plus incentive-fee form of contracting for not more than the first two low-rate initial production lots for such a project.
