IN THE SENATE OF THE UNITED STATES

Mrs. Shaheen (for herself and Mrs. Capito) introduced the following bill; which was read twice and referred to the Committee on the Judiciary


A BILL

To amend the Controlled Substances Act to lengthen the period of time during which certain controlled substances must be administered to a patient after being delivered by a pharmacy to the administering practitioner.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Delivery of a controlled substance by a pharmacy to an administering practitioner.

Section 309A of the Controlled Substances Act (21 U.S.C. 829a) is amended—

(1) in subsection (a)(5), by striking “14 days” and inserting “60 days”; and

(2) in subsection (b)—

(A) by striking paragraph (1);

(B) by redesignating paragraphs (2) and (3) as paragraphs (1) and (2), respectively;

(C) in paragraph (1), as so redesignated, by striking “the Attorney General,” and all that follows and inserting the following: “the Attorney General may modify the number of days described in subsection (a)(5) if the Secretary determines that the modification will—

“(A) reduce the risk of diversion; or

“(B) protect the public health.”; and

(D) in paragraph (2), as so redesignated, by striking “7 days” and inserting “14 days”.
